Form 944 is very similar to Form 941—in fact, this form is so similar to Form 941 that employers list the same information as they would on both forms. The only significant difference is eligibility and frequency of filing.
Only small business, defined as those with an annual employment tax liability of no more than $1,000.00, may file this form. But, you generally don't need to worry about eligibility too much because you will receive a notice from the IRS in the first week of February if you are supposed to file Form 944 instead of a Form 941.
Note that if the IRS sends you that notice, then you cannot file a Form 941 unless you ask and receive permission from the IRS to do so.
